ChristTube Terms of Service

Welcome to ChristTube! Please read these Terms of Service ("Terms") carefully before using our website, mobile applications, and services (collectively, the "Platform"). By accessing or using ChristTube, you agree to be bound by these Terms, our Privacy Policy, and our Community Policy. If you do not agree to these Terms, you may not access or use the Platform.

1. Acceptance of Terms & Eligibility

By creating an account, you represent and warrant that:

• You are at least 13 years of age. If you are under 18, you represent that you have the consent of a parent or legal guardian to use the Platform, and they agree to bind themselves to these Terms on your behalf.
• You are legally capable of entering into a binding contract under applicable law.
• You have not been previously suspended or removed from the Platform.
• Your use of the Platform will comply with all applicable local, state, national, and international laws and regulations.

2. ChristTube Account Security

To access certain features, including content creation and monetization, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information to keep it accurate, current, and complete.
• Maintain the security and confidentiality of your password and accept all risks of unauthorized access to your account.
• Promptly notify us at security@christtube.com if you discover or suspect any security breaches, unauthorized access, or compromise of your account credentials.

3. Digital Stewardship & Content Ownership

Unlike traditional secular platforms, ChristTube believes in the biblical principle of digital stewardship and complete user ownership.

• Your Content, Your Ownership: You retain all patent, trademark, copyright, and intellectual property ownership of any content (including videos, text, images, audio, comments, and graphics) that you submit, post, or display on ChristTube.
• License Granted to ChristTube: To operate, host, and distribute your content to your followers, you grant ChristTube a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, use, display, reproduce, modify, adapt, publish, and distribute your content solely for the purpose of operating, developing, and improving the Platform. This license is strictly operational and terminates automatically when you delete your content or your account.
• Data Portability & Network Ownership: We respect your private network. You have the right to export your subscriber lists, follower contact details (where users have opted in), and channel analytics at any time without fees, restrictions, or locked access.

4. Platform Monetization, Ad Standards, and Incentives

ChristTube empowers creators with direct monetization opportunities, promoting financial freedom to fund Kingdom work.

• Direct Relationships: If you host third-party advertisements, secure sponsorships, or receive direct electronic donations/payments on your ChristTube channel, you acknowledge that ChristTube acts strictly as a technical facilitator. Any agreements, contracts, or transactions are solely between you and the advertiser, sponsor, or donor.
• Tax Responsibility: You are solely responsible for determining, collecting, reporting, and remitting any and all taxes associated with monetization revenue, donations, or prizes you receive through the Platform.
• Ad Compliance: All self-run ads, sponsorships, and promotional material must comply fully with our Community Policy. ChristTube reserves the right to disable monetization, block specific ad codes, or suspend accounts that run ads violating our biblical family standards (e.g., gambling, explicit entertainment, deceptive products, or high-interest lending).

The $500 Early Adopter Blessing Campaign:

• To support pioneering leaders, ChristTube will distribute a one-time electronic donation of $500 USD to the first verified pastor, church leader, minister, or Christian music artist who reaches 5,000 followers on the platform.
• Anti-Fraud Provisions: To qualify for this blessing, followers must consist entirely of unique, authentic, active human accounts. The use of bots, click farms, self-created duplicate accounts, or purchased followers is strictly prohibited.
• Audit Rights: ChristTube reserves the absolute right to audit channel followers, verify the authenticity of the network, and request verification of the leader's ministry or artistic credentials before releasing any funds. ChristTube’s decision regarding eligibility and verification is final.

5. Bulk Upload Systems & Anti-Spam Compliance

To facilitate the transition from secular platforms, ChristTube offers a Bulk Invite tool allowing users to upload contact lists (email addresses) to invite their congregation or fan base.

• Consent and Permission: By utilizing the Bulk Invite tool, you represent and warrant that you have obtained explicit, lawful consent from each individual on your contact list to contact them, or that you have an established, ongoing relationship with them (e.g., active members of your local congregation or voluntary subscribers to your ministry newsletter).
• Prohibition of Spam: You agree not to upload purchased email databases, scraped contact lists, or unverified cold directories.
• Indemnification: You agree to fully indemnify, defend, and hold harmless ChristTube against any legal actions, fines, or penalties resulting from your unauthorized upload of email addresses in violation of the CAN-SPAM Act, GDPR, CASL, or other regional electronic communication laws.

6. Prohibited Conduct

You agree that your behavior on the Platform will align with our Community Policy. Specifically, you agree that you will not:

• Post, upload, or transmit any material that is illegal, sexually explicit, pornographic, or designed to harass, abuse, or stalk others.
• Reverse-engineer, copy, disassemble, or scrape the Platform's software, source code, or user directory.
• Engage in automated scraping or bulk email spamming through the Platform's messaging or invite systems.
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.

7. Copyright Policy & DMCA

ChristTube respects the intellectual property rights of others. If you believe your copyrighted work has been uploaded to the Platform in a way that constitutes copyright infringement, please submit a formal Digital Millennium Copyright Act (DMCA) notice to our designated agent:

Your formal notice must include:

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
2. Clear identification of the copyrighted work claimed to have been infringed.
3. The specific URL or location of the infringing material on ChristTube so we can locate it.
4. Your contact information (address, telephone number, and email address).
5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

8. Disclaimers & Limitation of Liability

• "As-Is" Service: ChristTube is provided on an "As-Is" and "As Available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
• No Guarantee of Income: While ChristTube provides the framework for 100% direct monetization, we do not guarantee any specific financial return, ad engagement, or sponsorship revenue to users of the Platform.
• Limitation of Liability: To the maximum extent permitted by applicable law, ChristTube, its directors, employees, partners, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages—including without limitation loss of profits, data, use, goodwill, or other intangible losses—resulting from (i) your access to or use of the Platform; (ii) any conduct or content of any third party on the Platform; or (iii) unauthorized access, use, or alteration of your transmissions or content.

9. Biblical Dispute Resolution & Christian Arbitration

In keeping with biblical mandates (such as 1 Corinthians 6:1-8 and the Matthew 18 principle), we believe that disputes between Christians are best resolved within the body of Christ rather than in secular courts of law.

• Direct Resolution: In the event of any dispute, controversy, or claim arising out of or relating to these Terms, you and ChristTube agree to first make a good-faith effort to resolve the matter privately, directly, and in a spirit of reconciliation.
• Christian Arbitration: If direct negotiation fails to resolve the dispute, you and ChristTube agree that any remaining dispute shall be settled by legally binding Christian conciliation and arbitration. This conciliation will be conducted in accordance with the Rules of Procedure for Christian Conciliation of the Institute for Christian Conciliation (a division of Ambassadors of Reconciliation) or a mutually agreed-upon equivalent Christian arbitration service.
• Waiver of Jury Trial & Class Actions: By agreeing to these Terms, both you and ChristTube waive any right to resolve disputes in a court of law before a judge or jury, electing instead to resolve disputes through Christian arbitration. Furthermore, you agree that any arbitration shall take place on an individual basis; class arbitrations and class actions are not permitted.
• Enforceability: This section is governed by the Federal Arbitration Act (FAA) and shall survive the termination of your account or these Terms.

10. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on the Platform and updating the "Last Updated" date at the top of this document, or by sending an email notification directly to your registered account. Your continued use of the Platform after the effective date of any modifications constitutes your formal acceptance of the updated Terms.

11. Termination

We reserve the right, without notice and in our sole discretion, to terminate your license to use the Platform, remove your content, and block or prevent your future access to ChristTube if you repeatedly, severely, or egregiously violate these Terms, our Privacy Policy, or our Community Policy.
